Construction / Design Terms & Conditions

At Urban-Eco Landscape Design, we are committed to providing high-quality landscape design and installation services tailored to each client’s unique needs. We strive for complete customer satisfaction and approach every project with professionalism and transparency. This Refund Policy outlines the terms under which refunds may be issued.

1. Scope of Work

Urban-Eco Landscape Design (“Contractor”) agrees to perform landscape design, installation, and related services as outlined in the client’s proposal or estimate. Any changes to the scope must be approved in writing and may result in additional charges as well as schedule slip. 

 

2. Estimates and Pricing

  • Estimates are valid for 30 days.

  • Pricing includes labor, materials, taxes, and markups unless otherwise specified.

  • Unforeseen site conditions (e.g., underground obstructions, poor drainage, excessive debris) may result in additional costs with client approval.

 

3. Payment Terms

  • 100 % of material costs are due upfront before work is scheduled or materials are ordered.

  • Labor is billed upon project completion and is due immediately unless otherwise agreed.

  • For larger or multi-phase projects, labor may be invoiced in scheduled installments at the contractor’s discretion.

  • Invoices not paid within 10 calendar days may incur a 5 % late fee, with an additional 5 % per month thereafter.

 

4. Design Services

  • All design work remains the intellectual property of Urban-Eco Landscape Design and is copywrite protected unless purchased separately.

  • Design fees are non-refundable and separate from installation charges unless bundled in a package.

  • Design fees shall be paid out to Contractor after each major design document revision. 

  • Design fees may be waived or reimbursed in part or in full at the discretion of the Contractor once construction by the Contractor has commenced. 

 

5. Material Substitutions

If specified materials or plants are unavailable, the contractor may substitute items of equal or greater value that meet the project’s aesthetic and functional goals. Substitutions will be communicated in advance with the Client.

 

6. Site Access and Conditions

  • The client must provide clear access to the site and ensure pets, belongings, and vehicles are out of the work area.

  • The client is responsible for obtaining HOA approvals .

  • Contractor is reasonable for obtaining required permits at cost to the client. 

  • Contractor is not responsible for damage to unmarked or improperly marked utilities or irrigation systems.

 

7. Warranties

  • Hardscape features (e.g., edging, patios, gravel pathways) are warrantied for 1 year against workmanship defects.

  • Plants are warrantied for 30 days after installation, provided the client follows watering and care instructions.

  • Warranty excludes:

    • Seasonal dormancy

    • Pests or disease

    • Neglect or improper watering

    • Damage from weather (freeze, flood, etc.)

 

8. Maintenance Responsibility

  • Unless stated otherwise in writing, ongoing maintenance (weeding, irrigation adjustments, pruning, fertilization) is the responsibility of the client.

  • Native and adapted plants may require seasonal trimming or thinning, which will be communicated upon installation.

 

9. Delays and Weather

Work may be delayed due to weather, supplier shortages, or other factors beyond our control. Urban-Eco will communicate promptly and reschedule as needed.

 

10. Photography and Portfolio Use

Urban-Eco Landscape Design may photograph the project before, during, and after completion for marketing and portfolio use unless the client requests otherwise in writing.

 

11. Cancellations

  • Cancellations must be submitted in writing once construction has commenced. 

  • Design and consultation fees are non-refundable.

  • If materials have already been purchased, the cost is non-refundable but may be delivered to the client, or restocking may be negotiated, subject to supplier terms.​

12. Legal Compliance

This policy complies with all applicable Texas state consumer protection laws. Nothing in this policy limits any rights you may have under Texas law.
